Terms of Service

These Terms of Service constitute a legally binding agreement between you (website visitor, purchasing customer, collectively referred to as “User”) and ELNIVITI, the operator of the Indonesia official fashion jewelry website, governing all website browsing, merchandise purchasing, email communication via [email protected], use of brand product images, logo intellectual property and all platform service functions provided by our brand. By accessing our website or completing any jewelry order payment on our website, you fully acknowledge reading, understanding and unconditionally agreeing to every clause within these Terms of Service. If you do not accept these service terms, you are prohibited from using our website and purchasing any ELNIVITI accessories.

1. Brand Intellectual Property Ownership Statement

Logo & Visual Copyright: The diamond line-art ELNIVITI brand logo displayed on our website, product packaging, gift boxes and all official communication materials is a registered graphic trademark fully owned by ELNIVITI. All original product photography on the website including photos of necklaces, earrings, brooches, bracelets, ear cuffs and accessory flat lay catalog images are protected by international copyright laws and Indonesian intellectual property regulations.
  2. Prohibited Unauthorized Usage: Users are strictly forbidden to copy, download, crop, edit, redistribute, reprint or commercially reuse our brand logo, original jewelry product photos, website graphic design layout and brand name text without receiving formal written licensing approval email from [email protected]. Unauthorized commercial use of our intellectual property will trigger legal compensation claims for copyright infringement in accordance with Indonesian local IP law.
  3. 2. Customer Information & Purchase Eligibility

Purchase Eligibility: Users placing an ELNIVITI order must be at least 17 years of age or above, holding valid Indonesian identity documents and legal capacity to enter commercial purchase contracts. Minors under 17 may only browse the website and view jewelry products without submitting payment orders to complete purchases.
  2. Contact Information Authenticity Obligation: Personal information supplied with an order, including full name, contact mobile number, delivery address and email, must be true, accurate and up to date.   3. Order Information Responsibility: Keep your order reference and private correspondence secure. Notify [email protected] promptly if you identify a purchase made without your authorization. Do not send complete payment credentials by email.

3. User Code of Conduct & Prohibited Website Behaviors

When accessing our ELNIVITI Indonesia jewelry website, users must comply with the following conduct rules; any violation will result in website access restrictions, order cancellation or a permanent website access ban depending on severity:

  3. Forbidden Technical Attack Behavior: Users shall not deploy crawler scripts, automated bot programs, hacking tools or data scraping software to steal website product data, customer order information or intellectual property resources, nor attempt to break website security encryption systems. Any detected technical attack behavior will be reported to Indonesian network regulatory authorities for legal investigation.
  4. No Off-Platform Transaction Solicitation: Users must not use communications associated with this store to solicit purchases from a third-party shop while representing those purchases as ELNIVITI website orders. Purchases made elsewhere are outside our official website order and after-sales arrangements.

4. Product Purchase & Order Contract Rules

  1. Order Confirmation Binding Contract: After successful payment for jewelry items at checkout, retain the confirmation and order reference provided for your purchase.   2. Price & Inventory Disclaimer: Jewelry product prices are shown in United States dollars (USD). Review the final total and any taxes or other charges displayed at checkout. Product availability may change; ELNIVITI reserves the right to cancel a paid order if an error causes incorrect displayed pricing or the goods are unavailable, with a full refund arranged for the cancelled order.
  3. Product Description Reference Standard: Website product size charts, material introductions, stone size and color descriptions are descriptive reference guides only; slight color difference between physical jewelry and screen display images may occur due to monitor brightness and lighting factors, which shall not be classified as a product quality defect eligible for free return shipping borne by ELNIVITI. Refer to the available product images when considering an accessory.

Order Modification Time Limit: Users may submit order address, product quantity or style modification requests via email to [email protected] only before our warehouse begins order processing (within 24 hours post payment). Once warehouse sorting and packaging starts, no further order content modifications can be accepted.

5. Brand Service Liability Limitation

  1. Uncontrollable External Factor Exemption: ELNIVITI shall not be held liable for order delivery delay, parcel loss or product damage caused by events outside our full control, including Indonesian government policy adjustments, customs inspection delays, domestic courier service malfunctions, natural disasters, force majeure public emergencies and user-submitted incorrect delivery address information.
  2. Maximum Compensation Cap: If ELNIVITI is confirmed fully liable for verifiable product defects or brand-side service errors resulting in customer losses, our total maximum compensation limit shall not exceed the full original payment amount of the single related jewelry order; we will not bear indirect losses including lost business profit, travel expenses or emotional damages.
  3. Website Temporary Service Interruption: We may conduct regular website server maintenance, system upgrades or technical repairs which cause temporary website access outages without prior advance notice to users. ELNIVITI will not compensate users for shopping opportunity losses during maintenance downtime.
  4. Third-Party Platform Exclusion: Our official website operates independently, unaffiliated with any third-party Indonesian e-commerce marketplace platforms; ELNIVITI does not take responsibility for counterfeit jewelry goods sold under similar brand names on external third-party shopping platforms. Customers must only purchase accessories through our official website to enjoy full warranty and after-sales protection.

6. Term Modification, Dispute Resolution & Governing Law

  1. Service Terms Update Right: ELNIVITI reserves the absolute right to revise, supplement or adjust any clauses within these Terms of Service at any time to adapt to updated Indonesian e-commerce laws, cross-border import regulations and brand business development needs. Updated revised terms will be published on the website legal clause page, at least 7 days before they take effect. Your continued website usage after the effective date of new terms constitutes acceptance of all updated provisions.
  2. Amicable Dispute Priority Resolution: Any dispute, disagreement or claim arising between users and ELNIVITI related to website services, jewelry orders, after-sales refunds, shipping logistics or intellectual property matters shall first be resolved through friendly written negotiation via official email [email protected], with both parties required to provide relevant order, product and communication evidence for mediation.
  3. Formal Legal Dispute Jurisdiction: If amicable email negotiation fails to resolve the dispute within 30 calendar days after the customer submits formal complaint materials, all unresolved legal disputes shall be submitted to the local commercial court with jurisdiction in Indonesia, governed exclusively by the commercial, consumer protection and cross-border trade laws of the Republic of Indonesia.
  4. Term Severability Clause: If any single individual clause within these Terms of Service is ruled invalid, unenforceable or illegal by Indonesian judicial authorities, the remaining full clauses of this service agreement shall remain fully valid and legally binding between both parties.
  5. Contract Termination Right: ELNIVITI reserves the right to unilaterally restrict your access to the website permanently at any time without refund of order payments if you seriously violate core clauses within these Terms of Service, including intellectual property infringement, malicious mass order fraud or repeated prohibited harmful user conduct.
